The following Terms and Conditions outline important policies regarding training sessions, payments, cancellations, safety requirements, and client responsibilities. By booking or attending a personal training session, you agree to the terms outlined below.
Preparation for Your Training Session
To ensure that you receive the greatest benefit from each session, please consider the following guidelines before attending your workout.
• Clients are encouraged to ensure they have adequate energy levels prior to training. This may include consuming food beforehand depending on the time of day and individual needs.
• Some clients may prefer to train before breakfast in the morning, while others may benefit from eating beforehand to help manage energy levels or blood sugar.
• Towel, water and refreshments will be available during training sessions.
• Please arrive on time so that your full session can be completed as scheduled.
• Comfortable training attire and appropriate footwear should be worn at all times.
Payment Policy
All personal training sessions must be paid in advance prior to the commencement of the session.
Accepted payment methods include:
• Cash
• Bank transfer
If purchasing multiple sessions or training packages, the full package amount must be paid upfront prior to the commencement of the first session.
Advance payment secures your training appointment and allows sessions to be reserved exclusively for you.
Failure to provide payment prior to the session may result in the session being cancelled or rescheduled.
24-Hour Cancellation Policy
A strict 24-hour cancellation policy applies to all training sessions.
If you need to cancel or reschedule a session, you must provide at least 24 hours notice.
Sessions cancelled with less than 24 hours notice will be charged in full and the session will be forfeited, as that time has been reserved specifically for you.
Providing sufficient notice allows the time slot to be offered to other clients.
No-shows or late cancellations will be treated as completed sessions.
Refund Policy
Refunds are generally not provided for personal training sessions or packages.
Refunds will not be provided in the following circumstances:
• The training location is considered too far or inconvenient after booking
• Change of mind after purchasing sessions
• Scheduling conflicts or personal commitments
• Lack of motivation or discontinuing training
Clients are expected to review the training location and policies prior to purchasing sessions.
The only circumstance in which a refund may be considered is when a client provides a valid medical certificate confirming they are medically unable to continue training.
In such cases, unused sessions may be refunded or credited at the trainer’s discretion.
Health Screening and Waiver Forms
For safety reasons, all clients must complete the required pre-exercise screening forms prior to beginning training.
These forms ensure that training programs can be delivered safely and appropriately based on your health history.

Adult Pre-Exercise Screening System (APSS)

These forms must be completed prior to the first training session.
Failure to complete the required screening forms may result in training sessions being postponed.
Clients must also provide accurate and honest information regarding medical conditions, injuries, medications, or physical limitations. Providing incomplete or inaccurate information may increase the risk of injury and may affect the trainer’s ability to deliver safe training.
Risk Acknowledgement
All forms of physical exercise carry inherent risks.
These risks may include, but are not limited to:
• muscle soreness
• strains or sprains
• fatigue or dizziness
• aggravation of pre-existing injuries
By participating in personal training sessions, clients acknowledge that they are voluntarily participating in physical activity and understand the associated risks.
Clients agree to follow all safety instructions provided by the trainer during sessions.
Safety and Trainer Instructions
Clients must follow all instructions given by the trainer during training sessions, particularly instructions related to safety and exercise technique.
If instructions are repeatedly ignored or unsafe behaviour occurs, the trainer reserves the right to:
• modify the exercise
• pause the session
• terminate the session
Sessions terminated due to unsafe behaviour may be forfeited.
Behaviour and Conduct
All clients are expected to behave respectfully during training sessions.
The trainer reserves the right to end a session immediately if behaviour is deemed inappropriate, unsafe, or disrespectful.
This includes behaviour directed towards:
• the trainer
• the training facility
• equipment or property
Sessions terminated due to inappropriate conduct will not be refunded.
Additional Participants or Training Partners
Some training sessions may allow an additional participant or friend to train alongside you.
Any additional participant must complete the same screening documentation prior to attending a session, including the PAR-Q and APSS forms listed above.
Participants who have not completed the required documentation may not participate in the session.
Outdoor Training or Shared Sessions
Where sessions take place outdoors or involve more than one participant, all individuals involved must complete the required screening documentation in advance.
Participants remain responsible for their own health and safety throughout the session.
Trainer Discretion
The trainer reserves the right to modify, postpone, or cancel sessions if circumstances arise that may compromise safety.
This may include:
• unsafe client behaviour
• undisclosed medical conditions
• illness or injury
• environmental conditions affecting safety
Client safety will always be the priority.
Limitation of Liability and Assumption of Risk
By participating in personal training sessions, clients acknowledge that physical exercise involves inherent risks of injury, illness, or physical strain.
Clients voluntarily assume full responsibility for any risks, injuries, or damages that may occur as a result of participation in training sessions, including those arising from the use of equipment, training techniques, or exercise programs.
To the fullest extent permitted by law, David Likhovetsky and DL Personal Training will not be held liable for any injury, loss, damage, or health complication that may occur during or as a result of participation in training sessions.
Clients acknowledge that they are responsible for monitoring their own physical condition during training and agree to immediately inform the trainer if they experience pain, dizziness, discomfort, or any other symptoms that may indicate a medical concern.
Participation in training sessions confirms that the client understands and accepts these risks.
Session Validity and Expiry
Personal training sessions and training packages must be used within a reasonable period of time.
Unless otherwise agreed in writing:
• Single sessions are valid for 3 months from the date of purchase.
• Training packages must be used within 6 months from the date of purchase.
This policy ensures that training services can be delivered effectively and that reserved training capacity is managed appropriately.
Extensions may be granted in exceptional circumstances such as medical issues or extended travel, at the trainer’s discretion.
Unused sessions that expire outside of these timeframes may be forfeited.
Illness and Health Considerations
Clients should not attend training sessions if they are experiencing illness, contagious conditions, or symptoms that may affect their ability to exercise safely.
This includes but is not limited to:
• fever
• contagious respiratory illness
• vomiting or gastrointestinal illness
• dizziness or severe fatigue
If a client is unwell, they are encouraged to notify the trainer as soon as possible so that the session can be rescheduled where possible.
The trainer also reserves the right to cancel or postpone a session if a client appears unwell or if continuing the session may pose a health risk.
Client safety and wellbeing will always take priority.
Australian Consumer Law
Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights that clients may have under the Australian Consumer Law or other applicable legislation.
Where services are supplied under the Australian Consumer Law, statutory consumer guarantees apply.
To the extent permitted by law, the liability of DL Personal Training for any breach of these guarantees is limited to the resupply of the services or the cost of having the services supplied again.
Agreement to Terms
By booking or attending a personal training session, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
